How do I benefit?<br />&#13;<br />
If you are laid off from your job, then you can sign up for unemployment benefits from the government until you &#8220;get back on your feet&#8221;. The duration of these benefits is limited, however they are a lifesaver for many people. You must have been laid off to be eligible, however, as opposed to having quit or been fired. You must also furnish proof that you are looking for a new job in order to continue receiving benefits, and there may be other requirements depending on your state, such as a certain amount of time worked at your employer before your claim is filed.</p>
<p>&#13;<br />
Sign Me Up!<br />&#13;<br />
Unemployment insurance is not something that you have to sign up for, but rather is paid for by taxes imposed on employers in most states, with three states requiring a minimal input from the employees. There is, however, no need to sign up for this program. After working with your employer (usually at least a year) you become eligible for these benefits. </p>

How do I Claim My Benefits?<br />&#13;<br />
Contact your state unemployment insurance agency to file a claim. The agency will help you determine if your time worked and wages earned make you eligible for the benefits. Contact the agency as soon as possible after becoming unemployed for the best results. Keep in mind that it may take a couple of weeks before your first check arrives. Also make sure that you know the information such as your employer&#8217;s address and your dates of employment or your claim may be delayed until you can get this information to your unemployment insurance agency.</p>

How do I Retain Benefits?<br />&#13;<br />
You must file claims either weekly or biweekly as determined by the unemployment agency and answer questions regarding any earnings you have made during the period, and job offers or refusals or work, etc. These claims are usually filed over the telephone or by mail, and are necessary to your continued eligibility.</p>
<p>&#13;<br />
When you are asked to report to your local Unemployment Insurance Claims Office or One-Stop/ Employment Service Office, you must do so on the date and time that you are asked to do so. Failure to report at the correct date and time can result in termination of your benefits. You must also continue to meet the eligibility requirements of your state to retain your benefits. </p>

Can I be Disqualified?<br />&#13;<br />
The answer is &#8220;yes&#8221;. If your reason for leaving your last job is due to anything other than a &#8220;lack of work&#8221;, then a determination will be made as to whether you are eligible for continued benefits. These determinations are made based on appropriate State laws and applicable federal laws. If you are denied benefits, you have the right to file an appeal. You must file this appeal within a certain time frame to be qualified, and your employer may file an appeal as well if they do not agree with the determination made. </p>

Your unemployment benefits are the result of a federal attempt to curb economic slumps and help affected workers get back to work without affecting their lives overmuch. The benefits were never intended to be a permanent replacement for work, and will end after a certain amount of time, however for their duration they are to act as a wage replacement.</p>

This means if you were injured while working or while on the job premises clocked in, you get some type of reimbursement. Employers must pay close attention to insurance for workers compensation.</p>
<p>Your reimbursement can be in a variety of different ways. If you got two fingers sliced off in a factory, you may get your medical bills paid and money for loss of wages as well as your recovery or rehabilitation paid for. Now not all companies offer all of those if any.</p>
<p>Some companies may have a worker&#8217;s compensation plan that offers one, two, or none of those benefits. If you were to die on the job, your company may give you what can be considered life insurance. This means that they may give you a monthly or weekly sum to your family because of your death.</p>
<p>Along with those benefits a business that already has work men&#8217;s compensation insurance for their clients or employees won&#8217;t have to worry about any legal action against them. Most businesses think they are saving money by not having this, however they are actually losing money. The reason they are losing money is because even if one person gets seriously injured and sues the business, they will pay more than they would have if they had insurance.</p>
<p>With this they may have had to pay one of the three plans, where a court of law might find the business or employer guilty enough to pay all three plans. That would of course leave them with a huge bill that could have easily been avoided.</p>
<p>Another important advantage of having workers compensation insurance is that the employees will feel safe and secure. The safer your clients or employees feel, the harder they will worker and the longer they still stay with you If you treat them right, they will stay and work hard at all times.</p>
<p>Insurance for workers compensation is important in any sense. Don&#8217;t be a fool and settle for less to save a few bucks. As an employer take it upon yourself to get workers compensation through a private insurer to save your company money and give your employees what they need to feel safe and stay around.</p>

			<content:encoded><![CDATA[<p>Now that most states require a certain level of car coverage for you to drive legally, buying auto insurance is no longer something that you can put off or refuse to do. There are a number of important considerations, the first of which is that you should shop first for an insurance company, and then for the policy.</p>
<p>In other words, do not make a decision based primarily on price or coverage, because a great deal by those measures means nothing if the company goes out of business or mismanages your claim. Before your worry about what kind of policy you need, find the right company first, because picking the wrong one can cost you plenty in dollars as well as in frustration.</p>
<p>First things first<br />If you do not have a copy of your driving record, usually obtainable for a small fee at the state motor vehicle agency, then you will not be privy to some of the most important information affecting your eventual coverage and its cost. One lady driver in Los Angeles wondered why her rate had skyrocketed and couldn’t seem to get a straight answer from the insurer. What she learned later should encourage you to “know thyself” in this regard, as well.</p>
<p>Forgetting for a time about her premium’s rising cost, the lady got a copy of her driving record as part of a job application, and noticed that a minor fender-bender had been recorded as an injury accident requiring hospitalization. Bingo! When this error was corrected, her policy premium fell to a third of its previous cost, and she even received a check to refund the overcharges. Don’t assume anything about your driving record if you haven’t seen a recent printout of it.</p>
<p>“Know thyself,” indeed. And you need to know about your car as well as your driving habits. Before shopping for a company get a firm idea of what you need in coverage, which is a function of the value of your auto, its condition, the distance you regularly travel, any installed anti-theft devices, your age and those of any other drivers, previous insurance details and other factors. Things will go a lot faster, and a lot smoother, if you have all your “ducks in a row” and keep the information at your fingertips during the company and policy “comparison shopping” process.</p>
<p>Fact-finding tips<br />There are various companies and government agencies that monitor and rate the insurance industry. Standard &amp; Poor is a well-known rating service, and your own state’s insurance commissioner is also a good a source of information. As you start shopping companies, choose ones that have high ratings, sufficient cash reserves and a good business reputation.</p>
<p>Now, reputation can be difficult to assess at times. A company that has been in business for many years, one that is apparently trusted by millions of other people, can still be a poor fit for you for other reasons mentioned here. And a smaller, newer firm may be an excellent choice, but how do you find out? After checking with Standard &amp; Poor and your state insurance office, you should also canvass your friends, neighbors and co-workers for their own experiences. Referrals are still one of the leading ways that insurance companies obtain customers.</p>
<p>When you have several companies selected, then it’s time to rate them on a number of additional factors. The most important is probably the method of contact, that is, whether you deal with the insurance company through an agent or directly. If you are not wise to the ways of insurance coverage, you may need a helping hand through the process, and that’s how agents make their living – by taking care of you.</p>
<p>Service with a smile?<br />If you don’t need taking care of, you can buy your policy wherever you want, even online (after doing some more investigating, of course). The next thing you want to know is about the company’s customer service. You want to be treated respectfully and cordially when you buy your policy, and you certainly will expect the same in the event of an accident. Check the Better Business Bureau and the online insurance forums to find out about the service quality of the various companies.</p>
<p>The amount of service, and where it can be obtained, may also be important to you. That is, if you are a busy professional who travels a lot, it may be important to have an insurer with a national office network, its own claims centers and people who will make your claims process a fast, efficient one. Again, if you don’t mind handling all the details yourself, in exchange for a lower policy premium, then that will affect your decision.</p>
<p>When you need roadside assistance, have to file a claim, or have any other problem, you want to know that you can reach someone day or night, weekend or holiday. Larger companies normally have call centers staffed around the clock. You want to know that your claim or other service request will be handled swiftly, effectively and, of course, professionally. However customarily, only a two thirds portion of your wages will be paid and not the entire amount.</p>
<p>When preparing to make a claim, at the outset you should inform your employer of your accident. <p><b>Social Security Disability</b></p>
<p>You must have both a medical condition which satisfies the criteria of the Social Security, as well as have been employed in jobs that are recognized by Social Security in order to qualify for these benefits. If someone is not able to work for more than a year owing to a condition of disability, usually benefits in the form of monetary aid are paid. The procedure to submit an application takes roughly 2 to 3 months. After this there is another waiting period of 6 months before the check can be collected.</p>

			<content:encoded><![CDATA[<p>The chief causes of construction site injuries and industrial death claims are unsafe work practices and unsafe work site conditions. These most often are caused by employers&#8217; failure to comply with federal and state mandated safety practices, failure to provide adequate safety equipment such as scaffolding, safety harnesses and fall protection devices, failure to provide safe and properly functioning tools and machinery, use of worn and failing cables, and trenches that have not been properly graded and shored. Excessive work schedules without adequate rest breaks and work in inclement weather and poor visibility also increase the risks workers face.</p>
<p>All job site accidents are covered by California&#8217;s (or other states&#8217;) workers&#8217; compensation laws.  But the benefits are limited and the injured worker never gets fully compensated for his/her full lost wages, and never for pain and suffering. Filing a law suit against the responsible third party (not the employer) is essential to the possibility of a worker&#8217;s receiving full compensation.</p>
<p> Many industrial accidents are caused by the negligence of a third party, such as a subcontractor, a vehicle driver, equipment operator or an equipment manufacturer. It is therefore essential to always file third party claims against the responsible parties in a job site accident. In this way the injured worker has the benefit of recovery through both the civil court and workers&#8217; comp system concurrently.</p>
<p>Often in California, both claims may ultimately be resolved together through a third party Compromise and Release settlement. This can occur through mediation with all parties present, including the workers&#8217; compensation representative/attorney who is seeking statutory workers&#8217; comp lien reimbusement from the civil settlement for comp benefits paid.</p>
<p><strong>Interesting Settlement</strong></p>
<p>In April, 2009, Michael D. Goforth settled the following case:</p>

<p><strong>Case Name: Gary Taylor v. Confidential refinery owner and Confidential Scaffold Contractor</strong></p>

<p><strong>Mediator</strong>: Hon. Raul A. Ramirez (Ret), Sacramento, CA</p>
<p><strong>Date of Settlement:</strong> April, 2009</p>
<p><strong>Type of case</strong>: Industrial/negligence</p>
<p><strong>Settlement amount</strong>: $1,500,000.00 ($65,000.00 from Refinery Owner, $1,435,000.00 from Scaffold Co). This case settled following one full day of mediation. The settlement was a third party Compromise and Release wherein intervenor agreed to waive its $322,614.17 industrial lien.</p>

<p><strong>Facts</strong></p>
<p>On August 3, 2006, plaintiff, then 51, was working as a pipefitter for Timec Company, Inc. inside of a Martinez, CA flexicoker reactor, during a refinery “turnaround” (shutdown).</p>
<p>The reactor is a multi-story cylinder with a circular metal dipleg (pipe) running vertically through its center.</p>
<p>The scaffold within the reactor consisted of steel planks connected in a rectangular configuration around the dipleg which left a gap between the metal planks and the dipleg. Brand covered the gap with wooden planks and plywood to prevent workers   from falling through the scaffold deck in the areas near the dipleg..</p>
<p>At the beginning of his shift plaintiff entered the reactor and began looking for a power source to connect his electric grinding tools.  When plaintiff stepped near the dipleg, a wooden board gave way and plaintiff’s right leg plunged through the deck to waist level.</p>
<p>Plaintiff’s left leg hyperflexed under his weight. Plaintiff was able to halt his downward plummet  by his elbows, shoulders, and large body size which kept him from passing entirely through to the floor below. Plaintiff fell forward with a twisting motion onto both hands and arms. He was able to get himself out of the hole and down a 7 foot ladder. First aid was rendered on site and plaintiff tried to continue working over the next several days, but noted progressive pain in his left knee. Within a few days of the accident plaintiff also complained of soreness all over as well as localized pain to his right shoulder.</p>
<p>Ultimately, plaintiff’s injuries were diagnosed as: left knee derangement, right and left shoulder ruptured tendons, and L2-3 and L4-L5 disc herniations. In November 2006 plaintiff underwent arthroscopic partial medial and lateral meniscectomy of the left knee. In December 2007 plaintiff underwent open rotator cuff repair of the right shoulder.</p>
<p>In February 2007 plaintiff returned to work for 43 days but stopped due to progressive pain in his shoulders, back and left knee. In January 2008 Plaintiff underwent left total knee replacement and did not return to work thereafter due to worsening back pain.</p>
<p>Plaintiff had worked for Timec for 6 months and as a pipefitter intermittently prior to that time for several years. Plaintiff’s contended that his injuries prevented him from returning to work as a pipefitter.</p>
<p><strong>Plaintiff’s contentions</strong>:</p>
<p>1.)   Scaffold Co. failed to safely build and maintain the scaffold that the plaintiff was using;</p>
<p>2.)   Refinery, as owner operator of the reactor, failed to protect the integrity of the work site or insure project safety;</p>
<p>3.)   Employer,  failed to inspect the worksite or properly train its workers.</p>
<p>4.)   Plaintiff could never return to work as a pipefitter as a result of his injuries.</p>
<p><strong>Defendants’ contentions: </strong></p>
<p>1.)  Plaintiff was inattentive to an open and obvious hole in the scaffold;</p>
<p>2.)  Scaffold Co. was not liable since it appeared that one of the contractors working on the project modified the scaffold;</p>
<p>3.)  Plaintiff’s back injuries were non-industrial since the medical file doesn’t mention plaintiff’s back complaints until some 5 weeks post-accident;  </p>
<p>4.)  Refinery had no liability because Scaffold Co. was responsible for the scaffold construction.     </p>
<p><strong>Intervenor’s contentions:</strong></p>
<p>1.)   There is no evidence that the employer did anything or failed to do something that caused the subject accident;</p>
<p>2.)   Intervenor is entitled to full reimbursement of benefits paid (medical $231,259.14, indemnity $91,355.03) pursuant to LC § 3850, et seq.</p>
<p>3.)   Any comparative fault assessed against the plaintiff may not be imputed to the employer.</p>
<p><strong>Experts</strong>: At the time of mediation the parties had not yet retained experts.</p>
<p>In the workers’ compensation case,  AME Joel Renbaum, M.D. reported that plaintiff’s back injuries were reasonably related to the industrial,  that plaintiff may require spine surgery in the future and that plaintiff has a 35% impairment of the Whole person.</p>
